Subscription Policy
1. What this policy covers
This policy explains how the monthly plans run: Evolve, and the monthly extras for an Origin site, which are hosting, the care plan and the AI chat assistant. They are provided by LaingLogic, based in Glasgow, United Kingdom.
Read it with my Terms & Conditions, my Refund Policy and, where I host your site, my Hosting Terms. Where your proposal says something different from this policy, the proposal applies, unless that would take away a right the law gives you.
The monthly plans are for business clients only: anyone buying for a trade, business or profession, a sole trader included. I do not offer them to consumers, people buying wholly or mainly for themselves, and your proposal records the business you are buying for.
2. What the plans include
Evolve is a website built for your business, then hosted and improved every month. Bookings, payments, sign-ups and customer accounts can be added to it. The Services page describes the plan, and your proposal sets out what it includes and costs for your site.
Your site runs either on my own platform or on Shopify, and your proposal records which. On Shopify, your Shopify plan is billed to you by Shopify and is separate from my fee.
3. Billing
- For Evolve, your first month's fee is invoiced when you accept your proposal, and I start work once it is paid. It covers the first month from your plan's start date. For a monthly extra, the first invoice is dated on the day the extra starts. After that, fees are invoiced monthly in advance on the same day each month, or yearly where your proposal says so.
- Every invoice is due within 14 days of its date.
- Your proposal shows the first payment date, the monthly amount and, for Evolve, the total you will pay over the minimum term.
- Prices are in pounds sterling. I am not VAT registered, so no VAT is added.
- You can pay by card, taken through Stripe, or by bank transfer.
If an invoice is still unpaid 14 days after its due date, I may pause the work, and the hosting of a site I host, until it is paid. I will tell you in writing before I do. Fees continue while a plan is paused for non-payment.
4. The 12-month minimum term
Evolve has a 12-month minimum term. It starts on the start date in your proposal, and I ask you to confirm it in writing before any work begins. There is no build fee: the build is paid for across the term, which is why your proposal shows the total payable over the term beside the monthly fee.
Your monthly price stays the same for the whole of the minimum term.
5. After the minimum term
When the minimum term ends, the plan carries on month to month at the same price. It does not start a new 12-month term unless we both agree one in writing. From then on, either of us can end the plan at any time, and it ends one month after notice is given.
6. Price changes
Once the minimum term is over I may change your monthly price, no more than once in any 12 months. I tell you in writing at least 30 days before a new price applies, with the new monthly price in pounds and pence, the date it starts and the reason for it.
If you do not want the new price, tell me before that date. Your plan then ends the day before the new price would apply, rather than one month after your notice, you pay nothing more, and I refund anything you have paid for time after it ends.
7. Ending a plan and reminders
- After the minimum term: the plan ends one month after you tell me, and I refund anything you have paid for time after that date.
- During the minimum term: you pay the monthly fees left in the term, reduced by any costs I save. Section 6 of the Refund Policy sets this out, with a worked example.
- Monthly extras have no minimum term and end one month after you tell me.
- If I end a plan for a reason that is not your fault, you pay nothing more and I refund any fees paid for time after it ends. I give you at least 30 days' notice, unless the law requires me to end it sooner.
To end a plan, email enquire@lainglogic.com or message me through the client portal. I reply within 2 business days to confirm the end date.
Before your minimum term ends, and at least every six months after that, I email you a reminder with the date and amount of your next payment and how to end the plan.
8. When a plan ends
On the end date, development, support and access to the client portal stop. If I host your site, the hosting stops too: for 30 days after it ends I make your site's files and data available to you, as section A14 of my Hosting Terms sets out, and if you ask, I help you move it to a new host. If your site is on Shopify, it stays in your own Shopify account and is not affected.
Once your account is settled in full, including any charge under section 7, the design and code made for your site are assigned to you, in line with the intellectual property terms in my Terms & Conditions.
9. Hosting and availability
Where I host your site, my Hosting Terms apply. I use reasonable endeavours to keep it available, but I do not promise any uptime percentage and no service credits are payable. The platform checks it every five minutes, and I give notice of planned maintenance where I can. Where your site is on Shopify, its availability is Shopify's responsibility under Shopify's own terms, as section 12 of my Terms & Conditions explains.
10. Suspension
I may suspend a plan, or a site I host, for the reasons in section A7 of my Hosting Terms: non-payment after written notice, a security incident, unlawful content, a court or regulator order, or to protect the platform or my other clients. I will tell you when it happens and what is needed to restore the service.
11. Governing law
This policy, and any dispute or claim arising out of it, is governed by the law of Scotland, and the Scottish courts (the Sheriff Court or the Court of Session) have exclusive jurisdiction.
12. Changes to this policy
I may update this policy. The date at the top of this page shows the current version. A change applies to plans agreed after that date. A plan already running keeps the version you accepted unless we both agree to change it. A price change under section 6 is not a change to this policy.
